Purpose of the Webshop Terms and Conditions ——————————————————————————– János Podmaniczky has issued these Webshop Terms and Conditions to set out in detail the terms governing the Webshop service and its use, the rights and obligations of the service provider and the customer, and other material matters related to the Webshop service. The Webshop Terms and Conditions contain the general terms of the legal relationship established between János Podmaniczky and the customer entering into a contract with him. Regarding matters not regulated herein, the Hungarian laws and official regulations currently in force concerning the service provider’s Webshop activities, as well as the provisions of the Civil Code, shall apply without the need for specific stipulation. 2.1 Publication of the Webshop Terms and Conditions Acceptance of the Webshop Terms and Conditions by the customer is a prerequisite for using the Webshop service. The customer is deemed to have accepted the terms by using the service—specifically, by registering. 2.2 Scope of the Webshop Terms and Conditions János Podmaniczky reserves the right to modify the Webshop Terms and Conditions, in whole or in part, at any time. The Webshop Terms and Conditions and any amendments thereto shall enter into force upon publication. The Webshop Terms and Conditions shall remain in effect for as long as the Webshop Service Provider operates the webshop service, and shall continue to apply to matters initiated prior to termination but not yet concluded, until such matters are finalized. 3. The Webshop Service ——————————————————————————– János Podmaniczky provides the webshop service to the customer subject to the following conditions. 3.1 Territorial Scope of the Webshop Service Due to the nature of the data network (the Internet), the interface maintained by the Webshop Service Provider is accessible from both domestic and foreign locations. However, János Podmaniczky accepts orders only for delivery addresses within the territory of the Republic of Hungary. Consequently, delivery to postal or other addresses outside the territory of the Republic of Hungary is not possible. 3.2 Data required for registration Personal information Surname First name E-mail address (for user login) Mobile phone number Password 3.3 Additional data required for ordering Delivery address Postal code City Street name House number Billing address Company name Postal code City Street name House number 3.4 Podmaniczky János makes the following declaration regarding the storage of the aforementioned data By accepting these General Terms and Conditions, the customer entrusts Podmaniczky János with the storage, archiving, and processing of the data; Podmaniczky János undertakes to handle the data confidentially, not to disclose it to third parties based on the existing legal relationship, and to store it securely on its servers. 4. Formation and modification of the Webshop contract ——————————————————————————– 4.1 General characteristics The contract is formed upon registration on the Service Provider’s online interface and the acceptance of these terms and conditions. Registration is a prerequisite for making purchases in the Webshop. Orders are created when the customer approves the order in its final form. Podmaniczky János reserves the right to……upon receipt of orders, if the authenticity of the registration data is questionable or unintelligible, the data shall be deleted, and orders placed using such data shall be deemed invalid. 4.2 Registration Upon providing their details during registration for the webshop, the customer gains the ability to place orders. Customers may freely browse the product selection and add items to their shopping cart without logging in. Customers log in to the store using their username and password, after which they may purchase the items previously collected in their cart. The purchase is completed by using the designated button on the website. 4.3 Modification or cancellation of orders In accordance with Act CVIII of 2001, the webshop software immediately sends a notification to the customer upon the placement of an order, confirming that the order has been received. If the customer does not receive this notification within 48 hours, they are released from any obligation regarding their offer. Podmaniczky János allows the customer to cancel their order electronically at any time prior to the commencement of order fulfillment. Once the fulfillment of the order has commenced, the customer will be notified via e-mail; thereafter, the order may only be cancelled by contacting customer service directly. Podmaniczky János’s customer service may accept or reject such requests based on the following guidelines: For orders involving cash payment upon delivery by a courier service, cancellation may be accepted for orders not yet handed over to the courier. If the courier service has already collected the products for delivery from Podmaniczky János, the customer may exercise this right at the time of delivery. In the case of bank card payments, cancellation may be accepted under the same rules as for cash payments, subject to the condition that the funds are refunded to the customer within 30 days; furthermore, any costs incurred during the banking transactions will be charged to the customer by deducting them from the refunded amount. The average fulfillment time is 5 days. 4.4 Payment Terms The customer shall settle the cost of the purchased goods and services electronically (via bank card) at the time of placing the order, in cash to the courier upon receipt of the goods, or via direct bank transfer to Podmaniczky János’s bank account. Podmaniczky János shall issue an invoice upon receipt of cash. The customer may accept all items of the order at once or refuse to accept the entire order. Should the customer refuse to accept delivery of the order, Podmaniczky János reserves the right to terminate the customer’s registration and/or cancel any other orders placed in the interim, at its own discretion. Podmaniczky János does not charge a fee for the use of a specific payment method that exceeds the costs actually incurred by the company in connection with that payment method. 4.5 In the event of unsuccessful delivery For standard delivery, the carrier attempts to deliver the ordered goods twice. Subsequently, the customer may collect the products from the designated postal pickup point for an additional 5 days. If the customer fails to do so, the seller will declare the order invalid and cancel it upon the return of the goods. 4.6 Order tracking service Customer service provides information regarding any questions related to the order. 5. Rights and obligations of the customer ——————————————————————————– 5.1 Right of withdrawal The customer has the right to withdraw from the purchase of the ordered product within 14 days of receipt and must return the product to the service provider in complete condition within 14 days of the withdrawal. In accordance with Government Decree 45/2014 (II. 26.), the costs of return are borne by the customer. To avoid disputes, a video recording should be made of the opening of the package containing the returned goods. The Seller is obliged to refund the purchase price of the goods—minus any verifiable costs incurred—to the Buyer within 30 days of receipt of the package. The right of withdrawal applies during the period between the conclusion of the contract and the receipt of the product. In the event of withdrawal, the service provider is not obliged to reimburse the consumer for additional costs resulting from premium shipping options, but only for the standard shipping fee. If, due to the nature of a specific product, withdrawal from the contract is not possible, this will be explicitly indicated in the product description. A recommended template for the notice of withdrawal is attached. Using wording that differs from the recommended template does not invalidate the withdrawal; the service provider will consider the withdrawal valid provided the Buyer’s intention to withdraw is clearly and unequivocally expressed in their statement and withdrawal is permissible for the product in question given its nature. 5.2 János PodmaniczkyPotential damage If the returned goods are presumed to be damaged, and such damage resulted from improper use, János Podmaniczky may claim compensation from the customer for the depreciation in the product’s value, in accordance with the aforementioned regulation. The parties mutually accept the video recording made by the Seller upon opening the goods as proof of damage to the package. 5.3 Warranty The Seller’s liability regarding statutory warranty and mandatory warranty obligations is governed by the provisions of the Civil Code and Government Decree No. 151/2003 (IX. 22.). 5.4. After-sales services János Podmaniczky undertakes after-sales services—beyond customer service and statutory warranty obligations (e.g., non-warranty repairs)—under a separate, individual contract. János Podmaniczky has not adopted a separate code of ethics (exercising the option provided by the law prohibiting unfair commercial practices against consumers). 6. Data protection, data security ——————————————————————————– 6.1 Data protection statement During the registration process required to use the service, János Podmaniczky records the following data regarding customers: data necessary for customer identification (customer username, password [one-way encrypted], and e-mail address) as well as name, address, and contact telephone number. To facilitate the delivery of ordered goods, Podmaniczky János provides the following data to the carrier or the carrier’s agent: time of order, name of the recipient (from the delivery address), company name (from the delivery address), full delivery address, order amount, order number, and the customer’s phone number and other contact details. 6.2 Modification of personal data Customers may modify or delete their provided personal data at any time via the Webshop’s user interface. Exceptions to this include the deletion of the following data: Unique identifier E-mail address Phone number Password Name modification Unique identifier Customers may request the deletion of their registration via the email address info@podmaniczkypince.hu or by calling customer service. The phone number is not a premium-rate number. 7. Final provisions ——————————————————————————– 7.1. Provisions regarding contracts between parties at a distance No written contract is created regarding these terms and conditions, and Podmaniczky János does not archive them. An exception may be made for customers with whom the majority of purchasing transactions are not conducted electronically. 7.2. Termination of the Legal Relationship The Webstore’s terms and conditions remain in effect as long as the Webstore Service Provider operates the webstore service, and apply to any matters initiated prior to termination but not yet concluded, until such matters are resolved. The customer may request the immediate termination of the contract at any time, provided there are no pending transactions and neither party has outstanding claims against the other. We will acknowledge such a request upon verification of the customer’s identity and terminate the user’s access to the store by deleting their registration. Podmaniczky János reserves the right to unilaterally terminate the contract in justified cases involving inappropriate behavior by the customer. **7.4.** Podmaniczky János **accepts no liability** for misuse resulting from the user’s negligence (e.g., disclosing a password to a third party); the company assumes no financial or moral liability for such instances. **WARRANTY, COMPLAINTS** We provide a warranty on the quality of our products in accordance with statutory requirements. If a product is proven to be defective, Podmaniczky János will naturally provide a refund or a replacement; this includes refunding shipping costs or sending a new product free of charge. The Customer is entitled to submit complaints and comments to the Seller in writing. The Seller is obliged to examine the complaint within 3 days and notify the Customer in writing of the outcome and any further steps to be taken. In the event of a legal dispute, the consumer may turn to a conciliation board.
